Essential Christmas New Year Reading

The December holiday season is upon us, and a favourite time of the year for many. Regardless of our individual beliefs, nearly everyone can agree that we must keep the focus of our respective holidays on our concerted wishes for what Christmas is all about, Peace on Earth and Goodwill toward Everyone.

In this Christmas edition we take the opportunity to wish all our members and readers the best of cheer for the festive season. We all hope that each and every one of you has a very enjoyable holiday season.

For those of us at home base we will be spending most of our time preparing for all the events that will be occurring in the New Year.

As most of you will know we have been fully involved in combating the recent Ministry of Health witch-hunt and now there is another reactionary player that has entered the scene and will keep us occupied in the New Year.

Recently our media contacts forwarded information as to the recent activities of Fair Trading Investigators. The Fair Trading Act comes under the Commerce Commission and the Crown Law office.

Three recent cases of breaching the Fair Trading Act have been brought to our attention.

The first case involved the marketing of product which, it was claimed, would make women’s breasts larger and firmer and was a natural alternative to breast implants. The promoters could not prove this claim in court and the end result was fines and costs totalling $109,365.

The interesting fact in regards to this case was that the advertising by these promoters was approved by the Therapeutic Advertising Pre-Vetting Service (TAPS) which is a subsidiary of the Advertising Standards Authority Incorporated. It is a self-regulatory body whose clientele comprises mainly advertising agencies and the media. TAPS advises advertisers on how to comply with the Medicines Act and the Advertising Standards Authority’s Therapeutic Products Advertising Code.

So what does this result mean for our practitioners? Any and all advertising (pamphlets, newspaper, magazines, websites etc.) even if the content has been approved by TAPS and the Advertising Standards Authority Incorporated, the content displayed must still be able to be proven in a court of law or face the real possibility of heavy fines.

The second case that was brought to our attention was a water purification system which resulted in a $60,000 fine. The test results produced in court showed that there were no measurable differences between ‘treated’ water that had passed through the system and untreated water.

The third case involved a corporation which sold and promoted a discredited ‘weight loss’ product called Body Enhancer. This corporation was found guilty of breaching the Fair Trading Act and ordered to pay $524,500 in fines and costs and ordered by the Auckland High Court to publish corrective advertising. It had been claimed by the promoters that the product would help reduce fat, control appetite and improve health and also stated that the product had been scientifically tested. In his decision Judge L.H. Moore found that “Body Enhancer” had been proved beyond reasonable doubt not to be suitable for any of the purposes claimed and not to confer upon its users any of the benefits alleged.”

Section 10 of the Fair Trading Act relates to misleading conduct in relation to goods. If the Commerce Commission decides that the labelling or representations made are likely to have breached the Act it can take a range of enforcement actions including issuing a warning, entering into a settlement on the basis of undertakings or taking court action either through the criminal or civil jurisdictions. Only the courts can decide if a representation has breached the Fair Trading Act.
We can confirm that none of these cases involved Chartered Practitioners, and in light of these events we have issued the following message to our members.

A Message to All Chartered Practitioners

During this holiday period check all your advertising pamphlets and website content to ensure that you have not made a claim that could bring the Commerce Commission or Medsafe investigators knocking on your door.

If investigators do knock on your door or contact you by email or by any other means — contact the Charter Administration Office immediately. Do not try to handle the case without contacting the Charter in the first instance. Under your insurance contract you are duty bound in the first instance to approach the Charter Administration with regards to any possible situation which could result in litigation.

There may be some practitioners who take the view that the three cases mentioned above were all entrepreneurs and not practitioners; therefore we should not be concerned. However, one of our members is at present having a tussle with the Broadcasting Standards Authority in regard to statements made during a television program. It appears that reactionary forces are making every effort to ensure that these authorities act as a censor for any public statement that is contrary to official government administrator’s point of view.

Christmas Pick-Me Ups


Feeling Stressed
One or more of the following suggestions may assist you to be in tune with the festive spirit and have as much fun as possible.

1.

Stimulating this acupressure point. The Heavenly Pillar acupressure point is found half an inch below the bottom of the skull on both sides of the neck, on the ropey muscles about half an inch outward from the spine.

Assists in relieving stress, exhaustion, burnout, hangovers, heaviness in the head, stiff necks and sore throats. A good description of many adults at this time of year! Pressure should be firm enough to feel pleasantly and should ideally last about three minutes. Resist the urge to massage or rub but rather just apply a firm solid pressure with the tips of two fingers

2. Taking an afternoon nap. Research psychiatrists in San Diego found that people performed far better in motor, perceptual and verbal tasks after taking a nap. Far better than those who were given some caffeine instead!
3. Make a powerful pick-me-up drink by whizzing 1/2 cantaloupe (or Water,) melon, 2 pears and a 2.5cm/1in piece of fresh root ginger.
4. Eat potato and cabbage soup! Many people are getting well below their daily requirements of iron which can leave you feeling tired and lethargic. Potatoes, cabbage and spinach are all great sources of iron and are also low-maintenance for an overloaded digestive system. Any dishes containing potatoes or dark green leafy vegetables will give you the iron of course. As will liver and red meats.
5.

Watch out for yourself exaggerating your financial problems. We all do this from time to time, but it can leave you feeling far more depressed about your finances than you need to be.

Next time you find yourself thinking things along the line of 'If I lose my job we will lose the house and have to live on potato soup forever' or 'We'll never be able to keep up with the bills and life will be a catastrophe'... try to force yourself to think more rationally about the situation and work out what would actually happen instead of allowing the equivalent of a nightmare to haunt you.

6. Don't forget that being cold can make you feel down. I know I'm not supposed to be recommending turning up the heating, but please don't go cold either. Put on hats and slippers if you need to. Snuggle together in a warm room. Stick an extra duvet over the top of you. Place silver foil on the walls behind your radiators so that you don't lose so much heat into the wall!
7. Lift yourself by lifting somebody else. "If you want to life yourself up, lift up someone else." You might, perhaps, leave little notes in the bags or book pages of your loved ones. Send a special card to a friend. Visit somebody bearing an unexpected gift
8. Try some rose essential oil - or light some candles. Rose aromatherapy oil. Use it in the bath or added to body oil whenever you are feeling low. Also lights or candles around the house to make things feel a bit special.
9. Have an early night. This can be a great way to recharge your batteries if you've been burning the candle at both ends. Not getting enough sleep is a sure-fire recipe for feeling grumpy and listless. Take to bed early with a hot drink and a book or the television for half an hour then turn off the lights and enjoy being whisked away by sleep!

And don't forget to get in the festive spirit and have as much fun as you can get your hands on while it’s up for grabs!

The NZ Art Guild is joining together with the Leukaemia and Blood Foundation of NZ to “Shave an Artist.” Yes - that's right - artists from all over NZ are shaving their heads to raise money and support the children and adults with blood cancers like leukaemia and lymphoma.

Six New Zealand children and adults are diagnosed daily with blood cancers like leukaemia and lymphoma.

The Leukaemia & Blood Foundation provides essential support not only for those patients, but for their families - support that can last months, and even years.
Top NZ Artists have donated 13 artworks which will be auctioned off at a one of a kind, not to be missed charity event. Waiheke Garden Party – highlight for the New Year

It will be an extra special Waiheke Garden Party on Saturday 10 January 2009, with entertainment from Kiwi iconic singer and dancer Tina Cross, ONZM, alongside Waiheke entertainer Grant Bridger, The Red Herrings and musical director Stephen Small. The New Zealand Healing Association Special Meeting

The New Zealand Healing Association, formed in 1965, was one of the first to sign join the Charter as an Affiliate Signatory at the Inaugural signing of the Charter.
The NZ healing Association has been through prolific times where it had members from throughout New Zealand but that membership has now whittled down to a small number and at the recent AGM, it was resolved to close the Incorporated body down--- to wind up.

In order to comply with the rules, there has to be an extra ordinary meeting to confirm this proposal. If the resolution is defeated, then The New Zealand Healing Association would have to find sufficient office holders to resume the incorporation, and continue as a viable body.

This special wind up meeting is to be held at the Auckland Horticultural Hall, Western Springs 14th March 2009.

The New Zealand Healing Association has been the vehicle by which the public can participate in the activities, pertaining to the welfare and health of the people of New Zealand. No particular brand of healing is held out as the one and only, for there are as many forms of healing as there are breakfasts in the year. Not only that there are aspects dealing with Diet, and the ways of thinking which all come into the scope of interest in the Association.

Through the membership, those who would like to be members of the NZ Charter of Practitioners are able to, by way of the Health Discipline they hold , which is recognized, not only by the New Zealand Healing Association but also by the New Zealand Charter of Health Practitioners Incorporated. A number of NZ Healing Association members are members of the Charter.

On February 28th at 7: 30 pm at the Auckland Horticultural Hall, Western Springs there is a Demonstration on Healing by a New Zealander, Geoffrey Morell ND JP who has received much acclaim overseas, who loves to get people better, but first they must be receptive to see him, then be prepared to change their way of thinking , as often ,that is the reason for the particular illness, and lastly be prepared perhaps to change the way of eating, in line with the teachings of the Weston A Price Nutrition Foundation, www.westonaprice.org When these are followed, they don’t seem to go back to see Geoffrey again; their friends do.

The Charge for the evening is $5:00 with all monies going to the Association.

Geoffrey is coming to New Zealand as a last ditch stand to avoid the last minute demise of the New Zealand Healing Association. To quote Geoffrey “When one believes in something, one can’t just let it rot away, even though I may currently live in Washington DC”
